Is Special Counsel Jack Smith Really “Independent”?

Special Counsel Jack Smith is not quite as he is portrayed in the media. He claims to be serving justice while ignoring examples of Democrat politicians likewise mishandling classified information.  What is worse, he has violated former President Trump’s attorney-client privilege by compelling his lawyer to testify to the grand jury.  But after all, Smith was appointed by Merrick Garland, so one does not expect integrity. 

The Press Conference 

Smith presented himself as a pious, just man in the face of gross misdeeds.  Hardly.  He is instead perpetuating injustice himself, even as he stared into the camera morosely and tried to convey otherwise.  One could sense a certain zealous glow in his eyes which indicated his deep ideological grounding, which is to say, Jack Smith is a Trump-hater.  Knowing that he was now leading the resistance, he wanted to acquit himself creditably.  Smith repeated the trope at his press conference: 

"We have one set of laws in this country, and they apply to everyone."

This ignores the fact that our politicians from different parties are not treated equally.  He stated this so pompously, but in fact his conduct is unethical.  Smith continued: 

“Adhering to and applying the laws is what determines the outcome of an investigation. Nothing more, nothing less."  

Not to worry then–no politics involved, right? 

Smith tried to wrap himself in the respectability of the institutions of the US Government: 

"The men and women of the United States intelligence community and our Armed Forces dedicate their lives to protecting our nation and its people.”  

This is a false appeal to patriotism which has become popular with leftists ever since the Russia collusion narrative. Indeed, referring to the “dedicated public servants” of the FBI falls just a little flat after the Russia investigation. Maybe ten or twenty years ago an appeal to our respect for the FBI might have been effective.  Now it’s a leftist dog whistle. 

…this isn’t the first time Garland’s corrupt Justice Department has violated Trump’s civil liberties. 

When Smith claims to have adhered to the “highest ethical standards,” one senses a touch of defensiveness. It’s as though he anticipates the criticism that he has not in fact conducted himself or his investigation in an ethical manner. 

How has it been unethical?  In two ways: 

1. Smith violated Trump’s attorney-client privilege by putting pressure on his lawyer to testify before a grand jury about Trump’s lawyer’s private conferences with Trump. 

2. Smith is prosecuting Trump for the same violations which Clinton and Biden were not prosecuted for. 

Trump’s attorney-client privilege was violated when his attorney, Evan Corcoran, became a key witness and was compelled to testify before the grand jury when a federal judge decided that attorney-client privilege did not apply, supposedly because Trump’s comments were “in furtherance of a crime.”  

Yet this isn’t the first time Garland’s corrupt Justice Department has violated Trump’s civil liberties. 

Smith’s Appointment by Garland. 

Smith was appointed in November of 2022 to investigate Jan 6th as well as the classified documents situation.  He’s like Robert Mueller 2.0, in that he targets the man and then finds the crime.  Garland stated that he appointed Smith because Trump will be running in the election as well as Biden:

“Based on recent developments, including the former President’s announcement that he is a candidate for President in the next election, and the sitting President’s stated intention to be a candidate as well, I have concluded that it is in the public interest to appoint a special counsel.” 

What Garland meant by this is that he wanted the investigation to be independent and a degree of separation away from himself.  But the fact is that he launched this investigation as a way to obstruct Trump from running once again in 2024–and winning.

Trump released an ad which includes an image (quickly) of Jack Smith, and seems to include him in what he terms “leftist prosecutors.”  I’m inclined to agree with that description of special counsel Jack Smith.  Otherwise, he wouldn’t collaborate in this unjust process: 

Trump portrayed his enemies as wolves.  That’s good, and many, especially Nadler, Schumer, Smith, and Schiff meet that description, given their predator like use of lawfare to persecute their political enemies.  The only problem is that wolves are kind of cool.  Maybe rats would have been more appropriate. 

Partisan? 

It’s reported that Smith is registered as an “independent,” and therefore we shouldn’t worry about any whiff of partisanship. Yet being an “independent” doesn’t mean what you think it means. 

Most independents vote almost exclusively for either Democrats or Republicans.  It’s a vain conceit: “I’m independent.” But few “independents” are actually open-minded swing voters. 

Also, Smith was involved in the IRS targeting conservative 504 groups scandal.  His name is mentioned six times in a letter by the great Congressman Jim Jordan, inquiring about the targeting of 501C4 groups by the odious Luis Lerner (another wolf) back in 2010.  That was a highly unethical operation by our government which puts the lie to Smith’s appeals to the rule of law and fairness.  According to Jordan’s letter

“[Smith]  was closely involved in engaging with the IRS in wake of Citizens United and political pressure from prominent Democrats to address perceived problems with the decision.”

Smith’s appointment was applauded by Laurence Tribe and Andrew Weissman (the unethical lawyer behind the Mueller investigation). 

Did you really think that Garland would appoint someone to fair-mindedly investigate President Trump?  Don’t make me laugh.
